Park Policy 2021

Elf Acres is a family venue so we expect guests to behave appropriately. Violating our park policies may be cause for ejection from the premise without refund. For more information, please review our Park Policies below.

BEHAVIOR
All guests are expected to behave in an appropriate family friendly manner. Unruly, disruptive or offensive behavior is strictly prohibited and may be cause for ejection without refund. Intoxication at any point is cause for ejection without refund and any guests suspected of intoxication will not be permitted to drive thru the venue or enter Santa’s Village. Elf Acres employs off duty police officers to keep everyone safe and handle any potential situations that may arise.

DRIVER AND GUEST RESPONSIBILITY / RESTRICTIONS
Guests must exercise good judgment and act in a responsible manner at all times when on venue premises, including but not limited to driving a vehicle or riding as a passenger thru the Trail of Lights, Santa’s Village, parking areas, entry and exit roads and all other areas in the venue. All vehicles and vehicle drivers must have a minimum auto liability insurance policy that is active and meets state requirements for coverage. Guests are strictly prohibited from driving in the venue while intoxicated. Any guest who is suspected of intoxication will be ejected from the venue without a refund and will be escorted out by venue personnel, security or off duty police officer(s). Guests must obey all oral and written warnings and properly use all vehicle safety equipment when driving and riding in any vehicle. Guests are strictly prohibited from exiting their vehicle at any time during the drive thru the venue’s Trail of Lights. Drivers are prohibited from exceeding speeds above 5 MPH at any time while on venue premise and are expected to exercise good judgement when driving, be aware of their surroundings at all times including paying attention to
other drivers, vehicles and guests. Guests are not permitted to enter any restricted area, including inside ticket booth, concession, merchandise and craft stands. Guests entering restricted areas may be ejected from the venue without a refund. Personal items that are lost in the venue should be reported to management. Elf Acres will make every effort to retrieve lost articles after normal operating hours.

By entering the premise that Elf Acres venue is located on, all guests agree to fully defend, indemnify and hold harmless Elf Acres from any claims, lawsuits, litigation, demands, causes of action, liability, loss, damage and/or injury of any kind whatsoever, whether brought forth by an individual or entity, or imposed by a court of law or any administrative action by any federal, state or local government body or agency, arising out of in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of Elf Acres, its officers, agents, employees, contractors, workers, vendors and their employees, invitees, volunteers or guests.

This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgements, awards, decrees, attorney’s fees and related costs or expenses, and any reimbursements to Elf Acres for all legal fees, expenses and costs incurred by it.

PHOTOGRAPHY
By entering the venue, guests grant Elf Acres the right to film, video, record or photograph them on venue property for any reason without payment or consideration. Elf Acres requests that all photographs or video taken by our guests be used for their personal use and enjoyment only. Any use, reuse or reproduction for commercial purposes without the express written consent of Elf Acres is strictly prohibited. Elf Acres reserves the right to refuse to allow photography of any kind as necessary at individual locations. No commercial photography of any kind is permitted without prior written consent of management.

DRESS CODE
In keeping with our family friendly environment and for safety reasons, Elf Acres enforces a dress code. Proper attire must be worn in the venue at all times, including shirts and appropriate footwear. Clothing or exposed tattoos with offensive language or graphics are not permitted at any time. Examples of clothing not permitted are those displaying:

Profanity
Pornography
Graphic violence
Support of drugs and drug use
Gang symbols
Promotion of discrimination against any group

Park admission may be denied if clothing or tattoos are deemed to be inappropriate by management and the guest refuses all reasonable options.

INCLEMENT WEATHER
As guest safety is our number one priority, there are certain weather circumstances that may cause the entire venue to close earlier than scheduled or not open at all. As soon as closures are confirmed, the venue’s Facebook page will be updated with
the park’s current operating status. Please check Elf Acres’s Facebook page or call prior to visiting on days when weather may be a concern.

LANGUAGE
Guests using profanity or abusive language, symbols or gestures, may be ejected from the venue without a refund.

LINE JUMPING
Line jumping is strictly prohibited. Guests are not permitted to save places in line or exit the line and return for any reason. Violators may be ejected from the venue without a refund.

LOST OR STOLEN ARTICLES
Elf Acres and its personnel are not responsible for lost or stolen articles.

PETS / PET KENNEL
Pets are welcome to ride in your vehicle while driving thru the Trail of Lights but are not permitted outside of your vehicle at any time, with the exception of service animals. If you choose to bring your pet with you in your vehicle and park in Santa’s Village after exiting the Trail of Lights, you may, at your sole discretion, chose to leave your pet in your locked vehicle while you are in Santa’s Village. Guests must use good judgement regarding this decision and should take weather, temperature, length of time and other factors into consideration when considering whether to leave their pet temporarily in their vehicle. Elf Acres is not responsible for guests decisions regarding care of their pets.

PROHIBITED ITEMS
Outside food, beverages, alcoholic beverages and coolers are not permitted to be brought into the venue. Pets (other than service animals) are not permitted outside of your vehicle at any time. Any items that are not permitted in the venue must be returned to your vehicle. For the safety and protection of all guests, Elf Acres prohibits the following items in the venue: firearms of any type; multi-tools; pocket knives or other similar items regardless of size; any explosives; any item used for personal defense, including pepper spray; any item(s) which may cause harm to any person, animal, vehicle or physical property; any controlled substances; and skate shoes or any footwear with wheels.

RE-ENTRY
Guests who leave the venue and plan to return must wait in line to enter upon re-entry. Guests who purchase admission for a single vehicle may not re-enter the Trail of Lights once they exit, without purchasing another admission for re-entry or purchasing a Season Pass by paying the difference in cost between that night’s admission price and the current Season Pass’s price. Guests who choose to re-enter the Trail of Lights (including Season Pass holders and those who choose to purchase an additional admission) after driving thru and exiting must exit the venue and re-enter the line. Season Pass holders must have their Season Pass sticker displayed on their vehicle’s front left windshield to gain entrance into the venue. Season Pass stickers that appear to be tampered with or removed and transferred to another vehicle’s windshield will be invalid and entry will not be allowed without purchasing a vehicle admission or another Season Pass into the venue.

TICKET REFUNDS AND RAIN CHECKS
Once guests have been admitted into the venue, NO exchanges, refunds, or rain checks will be given. Requests made for a refund after tickets have been purchased but before used, must be made before the last day of the event season, in writing by
email sent to info@elfacres.com. ONLY ONLINE CREDIT CARD TICKET PURCHASES will be considered for a full or partial refund if requested in accordance with the terms above and they will be handled within the sole discretion of Elf Acres Ticketing Manager on a case by case basis. Refund requests WILL NOT be considered for Tickets purchased at the Box Office.
